TAKE NOTICE that tenders are invited for the purchase of the land(s)
described below and will be received until 3:00 p.m. local time on July 16,
2010 at 24 Flint Avenue, P.O. Box 790, Bancroft, Ontario K0L 1C0. The
tenders will then be opened in public on the same day at the Town of Bancroft
Municipal Office, 24 Flint Avenue, Bancroft, Ontario K0L 1C0.
Description of Lands:

ALL and Singular those certain parcels or tracts of
land and premises, situate, lying and being in the Town of Bancroft, in the
County of Hastings, and being composed of part of Lot 1, Concession 15 and
part of Lot 70 West of the Hastings Road, both of the Township of Faraday,
now within the limit of the said Town of Bancroft, and which said parcels or
tracks of land may be more particularly described as follows:
PREMISING that the westerly limit of said Lot 70 has an astronomical course
of north 19 degrees 16 minutes 30 seconds west derived from observation,
and relating all bearings herein, thereto;
FIRSTLY: Part of said Lot 1, Concession 15;
COMMENCING at a point in the southerly edge of the York River where it is
intersected by the easterly limit of said Lot 1 distant southerly along the said
easterly limit 250.0 feet from its intersection with the westerly production of
the northerly limit of Lot 70 aforesaid;
THENCE continuing along the said easterly limit of Lot 1, Concession 15 a
distance of 118 feet, more or less, to a further intersection with the edge of
the York River;
THENCE continuing in a general northwesterly and northeasterly direction
along the said river to the point of commencement;
SECONDLY: Part of said Lot 70 West of the Hastings Road;
COMMENCING where a survey post has been planted defining the most
easterly angle of the said parcel, being distant 171.0 feet measured south
40 degrees 30 minutes west from a survey post planted distant 301.16 feet
measured south 12 degrees 42 minutes west from a survey post planted in
the northerly limit of said Lot 70 distant easterly thereon 445.9 feet from the
northeasterly angle of Lot 70 aforesaid;
THENCE south 40 degrees 30 minutes west 76.0 feet to a survey post
planted;
THENCE south 78 degrees 00 minutes west 103.90 feet to a survey post
planted in the westerly limit of said Lot 70;
THENCE north 19 degrees 16 minutes 30 seconds west thereon 119.0 feet
more or less to a point in the high water mark of the York River;
THENCE in a general northeasterly direction along the said high water mark
115 feet more or less to a point in a line drawn north 43 degrees 15 minutes
west from the point of commencement;
THENCE south 43 degrees 15 minutes east 158 feet more or less to the point
of commencement;
TOGETHER WITH a right-of-way in common with others entitled thereto
in, over, along and upon a part of said Lot 70 west of the Hastings Road,
more particularly described as follows:
BEGINNING at the southwesterly angle of the parcel hereinbefore described
“SECONDLY”;
THENCE north 78 degrees 00 minutes east along the southerly limit of the
said parcel 103.90 feet to a survey post planted;
THENCE north 40 degrees 30 minutes east continuing thereon and its
production 247.0 feet to a survey post planted;
THENCE north 12 degrees 42 minutes east 9.0 feet to a survey post
planted;
THENCE south 77 degrees 17 minutes 30 seconds east 168.97 feet to a
survey post planted in the westerly limit of Highway Number 62 according
to a Deposited Plan Number 891;
THENCE along the said limit of highway on a circular curve to the left of
radius 2914.79 feet a distance of 30.0 feet, the chord equivalent being 30.0
feet measured south 13 degrees 22 minutes 39 seconds west to a survey post
planted;
THENCE north 77 degrees 17 minutes 30 seconds west 143.71 feet to a
survey post planted;
THENCE south 50 degrees 11 minutes west 41.08 feet to a point;
THENCE south 40 degrees 30 minutes west 208.07 feet to a point;
THENCE south 78 degrees 00 minutes west 109.20 feet to a point in the
westerly limit of said Lot 70;
THENCE north 19 degrees 16 minutes 30 seconds west thereon 25.50 feet
to the Point of Beginning;
The parcel herein described “FIRSTLY” being shown outlined in red on a
plan of survey dated the 15th day of August, 1968, and the parcel herein
described “SECONDLY” being shown outlined in red and the right-of-way
herein described being shown outlined in green on a plan of survey dated
the 14th day of August, 1968, both plans signed by M.J. McAlpine, Ontario
Land Surveyor, duplicates of which plan are hereto attached to Instrument
No. 150687.
Minimum Tender Amount: $ 6,777.54

Tenders must be submitted in the prescribed form and must be accompanied
by a deposit in the form of a money order or of a bank draft or cheque
certified by a bank or trust corporation payable to the municipality and
representing at least 20 per cent of the tender amount.
Except as follows, the municipality makes no representation regarding the
title to or any other matters relating to the land to be sold. Responsibility for
ascertaining these matters rests with the potential purchasers.
This sale is governed by the Municipal Act, 2001 and the Municipal Tax
Sales Rules made under that Act. The successful purchaser will be required
to pay the amount tendered plus accumulated taxes and the relevant land
transfer tax.
The municipality has no obligation to provide vacant possession to the
successful purchaser.
