Conditions:
No representation is made concerning the condition of the lands, the title
or the zoning and the purchaser must satisfy itself and take the premises
"as is". The site is currently licenced as a waste disposal site and must be
closed in a manner satisfactory to the Ministry of the Environment. The
Ministry apparently holds a performance bond which may be available but
the proposed purchaser must satisfy itself in that regard.
The balance of the purchase price will be due on the closing date proposed
in the tender which must be no later than November 29th, 2013. A vesting
order will be granted only upon the purchaser paying the full purchase
price into court.
Offers may contain reasonable conditions or terms of payment but bids
will be assessed on the basis not only of price but also on the basis of
certainty and timing of the closing date. For example, and unconditional
offer closing within thirty (30) days with payment in full upon closing
would be a superior offer.
Tenders must be submitted in the form of an irrevocable offer to purchase
and must be accompanied by a deposit in the form of cash, bank draft or
certified cheque payable to the Accountant of the Superior Court of Justice
in an amount which is at least 10% of the tender amount.
