Legal Aid
Chapter: GENERAL QUESTIONS
riseg
Is the Legal Aid ON a Crown agency whose lien would survive a crown sale?
frank
Legal Aid is not a crown agency - it is operating by the Ontario Bar, which although funded by the Province is not Crown. I searched a sale property in Wainfleet last year which had Legal Aid liens on it, and called them to discover that they were not a Crown agency, they were anxiously waiting the sale so that they could go after any excess proceeds.

Someone correct me if I'm wrong but I think it is possible that "Legal Aid" leins can sometimes pertain to child support and would survive the sale. A recent example (although redeemed at the last minute) was Wayne Road in Sarnia. I asked a lawyer that works in both real estate and family court matters - they seemed certain that any order pertaining to child support payments would survive virtually anything one could throw at them.
