under and by virtue of a Writ of Execution filed with the Sheriff of the city of toronto, dated may 18, 2006 under writ file number 06-0004116, the real and personal property of gihan christopher anura de soysa, Debtor, at the request of TD canada trust, Creditor(s), I have seized and taken in execution all of the right, title, interest and equity of redemption of gihan christopher anura de soysa, Debtor(s) in and to: ALL AND SINGULAR that certain parcel or tract of land and premises situated, being:
unit 2, level 30bd3, york condominium plan no. 76; pt blk a pl 1227, pts 2, 3 & 6 66r5887, as in schedule ?a? of declaration b339024 as amended by d184953; s/t b328761 east york, city of toronto
municipally known as 3 massey square, unit 3102, toronto, ontario.
All of which said right, title, interest and equity of redemption of gihan christopher anura de soysa, Debtor(s), in the said lands and tenements described above, I shall offer for sale by Public Auction subject to the conditions set out below at:
393 university avenue, 19th floor, toronto, ontario, 416-327-5685 on thursday, april 20, 2017, at 11:00 a.m. (Registration from 9:30 a.m. ? 10:30 a.m.)
the sale of the aforementioned property is subject to the following terms and conditions:
The purchaser to assume responsibility for all mortgages, charges, liens, outstanding taxes, and other encumbrances. No representation is made regarding the title of the land or any other matter relating to the interest to be sold. Vacant possession is not included in the sale of this property. Responsibility for ascertaining these matters rests with the potential purchaser(s).
terms:
A deposit of 10% of bid price or $1,000.00, whichever is greater.
Payable at time of sale by successful bidder;
To be applied to purchase price; and
Non-refundable ? Failure of the successful bidder to comply with these terms and conditions may result in a forfeit of any deposits paid at the time of the sale or any time thereafter.
Ten business days from date of sale to arrange financing and pay balance in full at 393 university avenue, 19th floor, toronto, ontario.
All payments to be provided in cash or by bank draft, certified cheque or money order made payable to the Minister of Finance.
A Deed Poll will be provided by the Sheriff only upon satisfactory payment in full of purchase price.
