Title: Native Indian Residents

This is a hypothetical question only.  I will apologize in advance if I have offended anyone by asking this question. 

What if any differences may there be in an eviction process if a person who won a bid for a property discovered that the residents are Native Indians?

My understanding is that Native Indians do not have any special rights over Non-Native Indians when they live outside of a Reserve.  I heard that directly from a Six Nations Indian who did not live on a reserve - however that was about 15 years ago.  I've also recently heard about a lot of back pedaling by a small town's local government when they received complaints from citizens that live adjacent to and across from a Native Indian Woman who is breaking numerous by-laws and leaving her property looking like a dump.  The town council tried to force a change and was challenged on the issue due to her Indian status.  The town backed down.  As far as I know, the town is now essentially refusing to act on the complaints.  Seems like this type of instance may be another hidden "gotcha".

My understanding is that - technically, native americans (Ameridians) hold no status above any one else when they are off their reserve.  However, this is a thorny political issue and if you know anything about what is happening in Caledonia right now you will understand.

I usually don't bid on properties that have tenants are owner occupied specifically because of the problems that you can run up against getting them out and having your property left in one piece.

By the way, another issue is the problem of a vacant dwelling that might see the owner return and come after you.  One of the properties in Hamilton for example had the owner currently in jail.  One day he will come home and you will hear the words 'honey I'm home'.

Hey Frank, good point about the jail birds.  That never even occurred to me!  Is there a way of telling if the owner has been incarcerated?  How can one be certain about who is residing on the property.
