Title: Legal Aid Ontario
Post by: riser on August 28, 2007, 06:58:36 AM
Frank - thank you.
Rob and all others - this website is a great tax sale venue and inspiring site for a tax sale guys. Thanks you.
I have two questions. I?ve searched the archive and the Internet and found no answers to the two following questions:
Is the Legal Aid ON a Crown agency whose lien would survive a crown sale?
Is there a definite and up-to-date list of the crown agencies whose lien(s) would survive a tax sale

Thanks,

riseg

Legal Aid is not a crown agency - it is operating by the Ontario Bar, which although funded by the Province is not Crown.   I searched a sale property in Wainfleet last year which had Legal Aid liens on it, and called them to discover that they were not a Crown agency, they were anxiously waiting the sale so that they could go after any excess proceeds.

If you ever find a complete list please let us all have it.  When you do a search and you come across an agency which you suspect might be crown, just give them a call to make sure one way or the other.

Riser guy
This is actually Rob's site, I'm just a member looking to learn and exchange ideas with others.

Someone correct me if I'm wrong but I think it is possible that "Legal Aid" leins can sometimes pertain to child support and would survive the sale. A recent example (although redeemed at the last minute) was Wayne Road in Sarnia. I asked a lawyer that works in both real estate and family court matters - they seemed certain that any order pertaining to child support payments would survive virtually anything one could throw at them.

I think we are starting some really good discussion here. It would be nice if we could assemble a list of crown corporations that are common when dealing with tax sale properties. This would be great information and also very convenient for everybody.

Anybody care to start the list?  ;D

You may well be correct in terms of child support as those are court awards.  The Legal Aid I was referring to is the one where you get in trouble and can't afford a lawyer so you get one through this mechanism, you still have to pay and if you don't they attach a lien to whatever you happen to own.  I don't know the mechanism for child support awards (never been in that kind of situation personally) and therefore cannot comment on it, however I believe it to be a different vehicle than 'Legal Aid'.
