Title: Taxsale help

So a buddy and I won the tax sale on the Nation river a month back.  We walked the land before bidding and it was alright. We final got title last Monday, and went out to see the place.  Someone has erected a fence and has a horse on the property, we were greeted by a not so friendly dog... How do we proceed, we want to list the property.  Do I now own a horse?

looks like you need to call animal control to have them remove these critters.   8)

Now I am totally confused, and I find myself being apologetic to Dogma on behalf of my two 'friends'.

What on earth does a horse on the nation river have to do with a tax sale in Port Hope....can we somewhat stay on topic....just a little.  8)

The Municipal Act that we all respect,

May have made this for Dogma a bad bet,

For the tax sale will not defeat,

When the neighbor has made title with his feet,

Ten years may suffice,

To make it no dice,

I hope for a good end,

But don't play it cute,

See a lawyer to refute,

The neighbor expanding his land,

And to hold onto to your own sand,

This win is your first,

I fear your bubble has burst,

Mountainman has an interesting point.
He is referring to adverse possession.
The neighbour can legally claim ownership of the land after exclusively using the land for a minimum period of 10 years - continuously, openly, and without any contest from the registered owner.

If the land is under the Land Titles System(LT), however, claiming the land by adverse possession or squatter's rights is quite difficult unless the neighbour can prove that his squatter's rights had been taking place for 10 years BEFORE the conversion date of the land from Registry (R) to Land Titles (LT).

If the neighbour started using the land AFTER the conversion date, then he does not have any right or interest in the land as LT does not honour such rights.  That, I think, is the beauty of the Land Titles we have in Ontario, ie. a little safer now.

Nevertheless, tax sale buyers must ascertain themselves for any potential adverse possession claims at all times...

Any update on this? Would love to know. We visited a place today in Lindsay and faced similar situations for a property there. Didn't feel that it was a good buy  given the hassle of shooing someone away who may or may not have squatter rights

  These so-called "squatters" are just waiting for potential bidders (or even potential buyers, as I found in the past) to succumb to trepidation. Do your THOROUGH investigation, make your bid, and, perhaps, all other potential bidders will back off, and you will get a deal. You have the LT rules on your side, and the law, as your weapons against those trying to scare you off, so have at it. Faint Heart Ne'er Won Fair Maid!

  Your first order of business is to make 100% sure you are looking at the actual property you bought at the Tax Sale; it wouldn't be the first time (ask Dave2, and the fellow who broke into the wrong Marmora area property and improved the $$$$hit out of it, to the absent owners delight!). Consult a land surveyor, if necessary. Once you are absolutely positive it's your property, take the necessary steps to obtain vacant possession. I'm sorry we never heard back from the lady who bought the acreage (with squatters)  on Manitoulin Island a few years back, but I hope she fared well.

To me this entire season of summer

has been quite the bummer

I now retreat to my den

and will put away my pen

I will awaken and see you all

when I emerge in the fall

On tax sales this season I bail

one thing I won't do is pay retail.
