I added $10,000 to my bid (to cover gst, land transfer, etc) and gave it to them (credit later of course for any excess), and said give me the deed quickly.

My understanding from reading this forum is that you probably won't find any liens listed in the tender package and that yes you will have to do a title search to fully discover any liens or other surprises. 

The only liens that stay with the property when you buy it are those that have been executed by the Crown.

Hey Frank, good point about the jail birds.  That never even occurred to me!  Is there a way of telling if the owner has been incarcerated?  How can one be certain about who is residing on the property.

This is a hypothetical question only.  I will apologize in advance if I have offended anyone by asking this question. 

What if any differences may there be in an eviction process if a person who won a bid for a property discovered that the residents are Native Indians?

My understanding is that Native Indians do not have any special rights over Non-Native Indians when they live outside of a Reserve.  I heard that directly from a Six Nations Indian who did not live on a reserve - however that was about 15 years ago.  I've also recently heard about a lot of back pedaling by a small town's local government when they received complaints from citizens that live adjacent to and across from a Native Indian Woman who is breaking numerous by-laws and leaving her property looking like a dump.  The town council tried to force a change and was challenged on the issue due to her Indian status.  The town backed down.  As far as I know, the town is now essentially refusing to act on the complaints.  Seems like this type of instance may be another hidden "gotcha".

I think what they may be referring to is that you have to pay any taxes that have accumulated since the original calcualtion for the tax sale was done for the listing.  The land transfer tax I believe is a different issue and is separately payable by anyone on any property that is transferred into their name regardless of how you came to be the owner.  The tax man cometh...

From what I've been told, for tax sales, the only liens that you would be responsible for are those registered by the Crown.  Mortgages are forfeited if not collected previously and any other leins are not your resposibility.

Here's a map of the property that I made by superimposing the township lot plan over 1-10000 base map. The house that I was thinking that was on the property is at a position of about 2:00 wrt the end of the road. Did you see anything to indicate that house wasn't on this lot?

Greg, see the attached mod of your map.  The red square is where I think the house was roughly.  The Purple line is the narrow driveway down to the river.  The green area is the ravine area beside the river and was kind of mushy at the bottom.  Hope it helps you.

I'm wondering if anyone has had a chance to look at any of the Minden properties yet? Some of my observations:
The Gelert property, nearly 5 acres, appears to have a house with someone living in it. Did anyone else think that house was on the lot? The

I had a look on the weekend at what I'm pretty sure is the 4.5 acre Gilert property you mentioned.  There is no house on the property that I could see but there appears to be a large garden shed pretty much on what I believe is the property line.  There is a narrow road put in down the side of hill and it leads to a river.  The right side of the road drops off to a ravine.  I didn't cross the river to look at the other side but I know the Rail Trail which you cross at the cemetary goes around the back side of the property.  To me there doesn't look like there's much value in this property as I'm sure you'd have a hard time getting permits to build a bridge of any sort and the land on the road side of the river is pretty much useless.

I recently saw two ads for condominiums up for tender.  Does the winning tender claim the same rights to the original condo owner and does the winner take over ownership of the actual condo or just a portion of the common property?

I'm new to Ontario tax sales but I've already gleaned a lot on info from this site.  I'm a little conused about my liabilities when it comes to mortgages that are registered against a property that I have won in a tax sale bid. If the mortgagor has been notified and has not come forward before I register the property, am I still liable for the balance of the mortgage?  Can the deed transfer be delayed for any reason related to the mortgage being registered against the property?  Can anyone clarify this for me?
