Can anyone discribe the process of purchasing a new ROW?

I'm curious about the process of establishing a new Right of Way (ROW).  Assuming you have agreement from the current owner of the land that the new ROW will cross over, regarding price and location.  What other costs should one expect?

I assume legal fee's, but roughly how much?  Are surveys necessary?  If so, what would the ballpark price of a survey be, for a 500 - 1000ft ROW?  Municipal permit cost range, assuming one is necessary? Are there any other costs? 

Any idea of the amount of time a ROW may take to establish?

I would suggest you visit the nearest municipal office, and inquire with the planning department as to what their procedure is.  Generally, you will have to make an application to the 'committee of adjustment' - similar to applying for a severance.  You will need to fill out the necessary application and pay their fee (anywhere from $500 to $1,500), also if the right of way results in other things being uncovered, if yours or your neighbours lot is undersized for example, then will also have file an accompanying 'minor variance' application (usually a formality since it is an existing situation).

Survey fees will depend on the job at hand, call a local surveyor and get an estimate. 


Of course you will need to pay legal fees to effect the final transaction. 

Depending on the time of year (ie. surveying can be difficult in the winter, and in summer-foliage), this process can take anywhere from 3 months to a year to complete.
