Hi Everyone,
I checked out the properties in Red Lake on the OntarioTaxSales.ca website and am near the area. What I don't understand is one of the properties 'legal description' is 'except and minerals, ores' etc.. on or under the property. If you own the land, isn't anything of value also yours? Does this mean that if some prospector lays a claim under your property, they may dig up your property?
The other properties are described as PT Mining Claim. What does that mean, same thing or somebody already made a claim? Tried calling the town and was directed to the website.

Under the mining act, Unless you specifically own the mining rights, Any prospector can come and stake a claim on your property. The can come on your land and drill for samples and the best you can get from them is cost of damaged trees. I believe since these specify No surface rights, He go open pit or can go under you all he wants and pay you nothing.
In Chandos lake district there has been some recent cases where the people owned the land but not the rights and prospectors came in and mined all their land , owners received nothing, not even for the surface damage.When looking at land always check the mining rights and lumber rights.
Lumber is the same, you can buy land but if the previous owner sold the lumber rights...You are buggered as the rights owner can come and clear cut the land. Lumber rights are on the title

Thanks PFM 1011 for the very useful information.
As for lumber rights, I know someone that purchased land hoping to have it rezoned (agricultural land) and sold the lumber rights, again hoping that having the land cleared would help in being able to rezone the land to residential. A large enough piece of land in Caledon, near Toronto to build a subdivision. This person is hoping to have the land rezoned and then sell to a developer. Will the lumber rights that were sold continue to remain on the title? What effect will it have? Are the rights removed once the land is cleared?
The properties in Red Lake are all with the exception of mining claims and 2 are P/T claim. I'm told many people in that area sold their mining rights many years ago, in fact there is a huge gold boom in the area with Goldcorp owning most of the mines.

If someone sold the lumber rights, it would be registered on the title and stays with the land after a sale unless they just did a deal to clear the land.
