2006 bylaw general provisions
Existing Undersized Lots
Where a lot, having a lesser lot area and/or lot frontage than required
herein, existed on the date of passing of this By-law, or where such a lot is
created by a public authority or correction of title, such a smaller lot may
be used and a permitted building or structure may be erected and/or used
on such a smaller lot provided that all other applicable provisions of this
By-law are complied with and provided that a sewage disposal system can
be installed on the lands.

In one town that I worked for years ago, there was a little country lot of 35 x 60 feet, it stood on a corner in a subdivision that was done back in the 50's.   Modern day wisdom told the us that this lot was not buildable, and that there was insufficient room for a proper septic system (many of the other lots in the vicinity had problems).   and so the building officials denied the owners a building permit for many years.  I was going to tax sale on it, knowing that it would only be of interest to one of the neighbours to cure their problems...when lo and behold the owner came in with an Engineers report that there were new systems on the market that would tame all of the effluents that they could generate ont his undersized lot.  Whamo, he paid the back the taxes and was granted a building permit.    Lesson learned.

Occupying what used to be a driveway, it's a one-bedroom, one-bathroom house that sits on a parcel of land 7.25 feet (2.2 metres) wide and 113.67 feet (34.6 metres) long and has an interior area of just under 300 square feet (under 28 square metres). The asking price is $179,900.!!!!

 Larry , your not hearing me this is not a city, not a town its a township. Rural . No sewer . No water. You have to put in your
sepitic and dig or drill your own well.And no I am not dissapointed , I just hope you got it writing. As for the neighbours how long do
think those houses have been there, by-laws come and go. I hope things work out for you but if you been reading along a few
people walked away from their deposits because they didnt do their homework.

I tend to agree with you on one point.  The water and sewage approvals.  Health Units can be a real pain to deal with.   It greatly helps if there is an existing sceptic system even if non function.  In those cases because they are grandfathered sometimes they tend to be more lenient.

That 'house' was actually sold in a tax sale or city surplus land sale.  The owner of the home that its attached to thought it was part of his lot and built a garage, but it wasn't and he got away without paying any taxes on this lot or any lease to the city, until someone woke up.  The owner of the house could have bought it since he had already built the garage, but someone else got it and as previously stated, renovated it wall by wall its now a little doll house and no longer a garage.  I guess the electricity, water, heat is now separate from the house that its attached to, that was somehow managed.  Its cute, I wonder if anyone will buy it?
I've seen quite a few of these 'garages' on tax sale, been checking this site for a few years now.  I don't know if its such a good idea though, to buy, build and try and sell, would anyone buy such a place?  You could build a nice home on 40 ft. frontage and it could be sold, if its not 'too different' or 'too small' compared to the homes surrounding it and if there are others of similar size in the vicinity.

Pfm1011   You seem to be a good reseacher but can you read. There are 2"may be"and 2"provided thats" in the clause.That might
set off alarm bells for some people that you could be getting a expensive whizzing match with the township. I thought purpose of this site was to warn people of potential problems like this.If your interested in research try township of seguin planning issues like
suing there own planning board. Sounds like reasonable people to deal with ?

  MAY means permission as in CAN..not "possibility"  This is a legal document , not a conversation at a bar.  All cities MAY (as in possibly)  be a pain but the bylaw is clear. They MAY  ( as in possibility)  bust your chops in regards the septic but provided (on the condition)that you are not a dick ( as in A**hole) to them, they MAY,( as in possibility)  , just be easy to deal with as they MAY (as in possibly) want people living there and paying taxes so that they MAY ( as in possibly) get a paycheck. . So provided (on the condition )that you comply with the zoning bylaw you MAY ( as in possibility ) actually be told by MAY ( girls name)you MAY ( as in permission) begin construction next MAY ( as in month) provided that ( on the condition) the MAY ( as in blossoms of Hawthorns) on the Property are not protected from MAYING ( as in picking flowers) . Of course I MAY (expressing contingency) be wrong but We MAY ( as in possibly) know by next MAY ( as in month) ...MAYBE

Now I don't mean to be rude, but why buy a property that is too small to be buildable when there's 3 properties 5 mins away that are a stones throw from waterfront! Oh and cheaper I almost forgot to add. Research local prices and you won't regret it as much.

This lot is not too small to be buildable. The lots in Napanee were 80 frontage by 200 deep and they were buildable. It is a very nice area, the airport is not a big issue, you should know that if you live around Pearson. The airport at Parry Sound is a small one, not too much traffic there.
