I realize we have discussed this issue at length in the past but how can a simple blanket statement protect the Municipality, or others listing property information for the Municipality, from supplying false information.
Ontario Tax Sale site has a property listed as 200 acres however Township maps show it as clearly 133 acres.
Granted, someone could have been provided with the wrong information  at OTS but in the end they don't really care because they are not accountable.....same as the Municipality.
Winning tender may be disappointed being 67 acres shy of their expectation.

We called this property 200 Acres based on the following information:

• The current deed to this property, in which the land is described as including, "Lot 29, in the Eleventh Concession, containing 200 acres more or less"
• The municipality's own GIS map.  Here's a link to it--the property in question is the third button from the bottom on the scroll bar on the right hand side of the screen:

It's easy to say 200 acres more or less. Problem is, in this case it is less. I realize that you are stuck in the middle because that is the information that you have been provided but if Township officials looked at the original map layout for Palmerston Twp. they would see that Lot 29, Concession 11 is listed as 133 acres.
Whereas most of the original lots in Palmerston were 200 acres,or thereabouts, the lots on the extreme eastern  edge of the township made up for the difference. This was common practice. Sometimes the "leftovers" are a little bit bigger but in many cases they are quite a bit smaller.
This particular lot was deemed to be 133 acres as the eastern township boundary actually angles inward. In fact a couple of lots north there is a lot listed as 95 acres on the old township map, as it is the lot most affected  by the inward angle of the eastern township boundary.
Regardless, my point is that when someone wins this at a tax sale they will have no recourse as the " Municipality makes no representation regarding the title to or any other matters relating to the land to be sold."
I wouldn't have an issue if the property was listed as Lot 29, Concession 11 but as soon as you mention acreage you should be somewhat accurate.

Newer at this..... but why would anyone want that lot anyway?... There is no way to get there!  Are these properties ever bid on? I don't see the point.  Am I missing something?

On the upside, they aren't under water, like the Sunfish Lake ones in Wilmot -- those I definitely don't get.

That much land could be a useful hunt camp, etc, IF there is legal access to it.  But in this particular region, if there's isn't defined access, it may get much harder to get to in the years ahead what with the large lands claim settlement making its way though the paperwork process. 

Back to Ruok's original thread, I'd be inclined to lay blame at the municipality for any incorrect details.  For properties that aren't 'featured' on OTS, I always assumed they just picked up the details from the Gazette and reposted them along with links to the property searches, etc.  The only time I'd anticipate OTS or TT doing any extra work would be for the featured listings, which they'd be making revenue on.

If anyone has any clever thoughts on what you'd do with the Wilmot lots though I'd love to hear them.

You're correct that this property is a bit of a dog and access isn't clear cut but that really isn't the point. As it stands now there isn't a whole lot of accountability from the Municipality on any listings.

Surprisingly you will find that is not uncommon on tax sale properties that have been around for a long time.  The owner has never challenged the valuation. 

Needless to say that is something you should look at if  you are successful.
