Are tax sales final?
« on: September 27, 2021, 01:36:21 PM »
Someone on social media is claiming that a property sold in a tax sale can be recovered by the previous owner is they paid their debt within 12 months of a property being old in a tax sale tender. That I would just get my money back, but title would go back to them. I don't believe this but I want to confirm. Is the tax sale final once the balance is paid?

OK, so fair enough. It seems BC is different where the person who owed the debt has 12 months to get a property back. So the rules differ by province, but if the property tax is set by the municipality, couldn't the auction rules vary by municipality as well? ...or is the tax sale process 'regulated' provincially? This seems odd to me. When someone says 'crown debt', I guess I just think federal.

Hi, no they cannot. In Ontario they have time until Deed is not transferred to bid winner. Once Deed is on your name (transferred) your are the owner.

Here are the provincial regulations.

https://www.ontario.ca/laws/regulation/030181

You can also dig up a few cases on Canlii

Perry Township Tax Sale No. 92-1 (Re), 1993 CanLII 8472 (ON SC)

and of course the famous one penny  case with Frank  who is likely the most knowledgeable person on this site..

Who is  Frank in the one penny case? Carrocci? or the guy who paid one penny short for the deposit?  :D

I also dug out Marsh v. Quinte West (City), 2017 ONSC 6869 (CanLII) https://www.canlii.org/en/on/onsc/doc/2017/2017onsc6869/2017onsc6869.html?searchUrlHash=AAAAAQAKInRheCBzYWxlIgAAAAAB&resultIndex=35 wondering if it's because the treasurer read it thus the recent Orkney Beach property got cancelled?  :)

Frank was the lower bidder who won at the end of the day.
