Hey,
wondered if anyone has any information on the property at Glen Hill Drive, Whitby.
I believe if you win the tender you also win the guy living there. How do you get him out???

     I drove by there twice checking out the place, as I slowed down when approaching the address I noticed him working on the outside of the house. There must of been a lot of people checking out this guys house because he was UPSET. I didn't even get out of my car. He just about chased me up the street waving his fists and yelling. He knows we are all checking out his place to pick it up for a discount price. I haven't done a title search, so I don't know if this guy has huge liens against the house but I think he will end up paying the $45,000 and the sale will be canceled.
     If not then who ever does win is going to have one hell of a time trying to get him out, thats if he doesn't destroy the place after the sale.

I have been by the place twice.  First time the windows were taped shut, blinds pulled and the upstairs window was wide open and the hydro meter was spinning like crazy.  I thought maybe the windows leaked, or maybe the place was a grow op.  Second time I realized the windows were being painted. Maybe the owner is fixing the place up to sell .  I am sure this one will be canceled

Be careful on this one if you are successful.  You have right of eviction if you exercise it right after getting title.
If you do not excercise your rights within a reasonable time frame he will gain tenancy rights under landlord and tenant act.  Eviction in this case once it falls under landlord and tent much tougher. 

I don't expect he will be a happy camper and don't know if I would want a vengeful person as a tenant as he may decide to take out his displeasure on you or the winner even though you had nothing to do with his misfortune.

Just an FYI in cases you did not get a tender package from the town of Whitby, our grumpy friend is comming up with the money. My wife got a call today from the town and they said the tax sale was being postponed. The other property (vacant lot) is still up for sale.

Does anyone have any experience with postponed tax sales. I was under the understanding they could only be cancled once the taxes owing are paid in full???

When they are cancelled, only to reappear a year later, it is usually because the owner has come in and made convincing arguments (usually with his Councillor, or the Mayor at hand) that he would be true to his word and pay up...there is a two year extension agreement that can be negotiated.  However, when he defaults again, the wheels are back in motion.  Either that, or someone at Town hall suddenly becomes aware that there was a screw up in terms of notices to lien holders, and they cancel the registration, but immediately re-register and a year later it is business as usual.

This is from Franks post on Springwater.  Perhaps grumpy is being given more time.  I think he is fixing it up to sell.  Happy hunting
