Best course of action is to contact a surveyor in the area of the property because he will not charge you for your initial questions. He will be well aware of those on the local Planning Board as well. Seems to me that you should apply for a Lot Addition scenario. The process is usually much less involved than a formal severance option but a lengthy process nonetheless because of the bureaucracy. Planning Boards are not always easy to maneuver as there is little consistency from one Municipality to the next. That's where a good surveyor is an asset. Good Luck Pfm!

Municipalities have to follow a certain protocol whereby they must offer all lands that fall into tax arrears after a two year period. You would not want the Municipality to dictate which lands they keep and which to advertise for tax sale. I understand your genuine concern about selling "unbuildable land" but anyone has the right to sell unbuildable land. You should be more concerned that they can sell land with substantial liens that survive the tax sale process. That does not seem right. The key to any of this is to do your homework so that you do not get burned. Those who have done this long enough know that at some point you are going to have a costly experience even with all your safeguards in place. Too many odd little situations that can happen.

Think the list Rob has shown is for lands that are located within "Unorganized" Townships. Those property taxes are still collected by individuals working out of their house. Taxes are then sent to the main provincial office in Thunder Bay. If and when the lands are eventually lost for no-payment the lands are vested in the Crown. To date, these lands have always remained with the Crown as they have never conducted Tax Sale proceedings on  these lands.Most of them are vacant lands in northern Ontario therefore its doubtful that these will be sold by the province as they simply would not generate a great deal of revenue. That being said, it would be nice if they changed their stance on this matter and introduced tax sale proceedings on these properties.

I'm with Matt on this one. Biggest mistake is definitely lack of homework. If you are not careful you will end up in trouble at some point. One lien can cost you thousands. As much as we tend to call this a game....it's far from a game when big money can be lost.

You're correct that this property is a bit of a dog and access isn't clear cut but that really isn't the point. As it stands now there isn't a whole lot of accountability from the Municipality on any listings.

It's easy to say 200 acres more or less. Problem is, in this case it is less. I realize that you are stuck in the middle because that is the information that you have been provided but if Township officials looked at the original map layout for Palmerston Twp. they would see that Lot 29, Concession 11 is listed as 133 acres.
Whereas most of the original lots in Palmerston were 200 acres,or thereabouts, the lots on the extreme eastern  edge of the township made up for the difference. This was common practice. Sometimes the "leftovers" are a little bit bigger but in many cases they are quite a bit smaller.
This particular lot was deemed to be 133 acres as the eastern township boundary actually angles inward. In fact a couple of lots north there is a lot listed as 95 acres on the old township map, as it is the lot most affected  by the inward angle of the eastern township boundary.
Regardless, my point is that when someone wins this at a tax sale they will have no recourse as the " Municipality makes no representation regarding the title to or any other matters relating to the land to be sold."
I wouldn't have an issue if the property was listed as Lot 29, Concession 11 but as soon as you mention acreage you should be somewhat accurate.

I realize we have discussed this issue at length in the past but how can a simple blanket statement protect the Municipality, or others listing property information for the Municipality, from supplying false information.
Ontario Tax Sale site has a property listed as 200 acres however Township maps show it as clearly 133 acres.
Granted, someone could have been provided with the wrong information  at OTS but in the end they don't really care because they are not accountable.....same as the Municipality.
Winning tender may be disappointed being 67 acres shy of their expectation.

A number of years ago, I also found an old headstone on a tax sale property that I won. It was still upright and in fairly good shape considering it had been there since 1918.The property was heavily treed and there was thick brush all around the headstone.  When I sold the property a few years later, I  advised the buyer of my find and showed them the secret location. The husband and wife took it upon themselves to be the caretaker of the site especially since it was for young child.
In my case I was upfront and it worked out, but that being said, it could have been a real disadvantage in trying to sell.

Sorry Dogma, think my response was a little vague. Crown liens will survive a tax sale and subsequently be the responsibility of the new owner.

Crown liens should not affect the minimum tender but they can certainly affect the new owner. In this case there does not appear to be a lien on the subject property but you do have to be extremely careful because of its history.

I know this topic has been discussed numerous times but I still think that the minimum tender amounts are sometimes extremely padded in favour of the Municipality. Twp of Brudenell, Lyndoch and Raglan have listed an old mining property with a minimum tender of $12,500 however the tax arrears certificate is in the amount of $2,987. I realize they can increase the amount to offset some of their costs to conduct the sale but adding $9,513 seems a little excessive.
Is there no protocol in place or can they do whatever they please?

Electrical issues can be a major problem as they have usually been altered or rigged for the increase in the output required for a grow op.
